Does my small business really need to comply with POPIA?
Yes. There is no small business exemption under POPIA. Any business that processes personal information β which includes collecting customer names, phone numbers or email addresses β must comply regardless of size. This includes sole proprietors, small shops, salons, contractors and any registered business.
What is a PAIA Manual and why do I need one?
A PAIA Manual is a document required under Section 51 of the Promotion of Access to Information Act. It describes what records your business holds and how people can request access to them. It is legally mandatory for all private businesses. Not having one is itself a violation that could trigger a POPIA investigation.
What is an Information Officer and how do I register one?
An Information Officer is the person legally responsible for POPIA and PAIA compliance in your organisation. For small businesses this is usually the owner. They must be registered on the Information Regulator's eServices portal. Operating without a registered Information Officer is a POPIA violation.
